Merchant Participation
The participating business authorizes The Secret Mice of
Sarasota to display the business name, address, telephone
number, website, submitted images, promotional information,
offers, events and other materials supplied by the merchant
in connection with The Secret Mice of Sarasota program.
Submitted Content
The merchant represents that it owns, controls or has
permission to use all photographs, logos, trademarks and
promotional materials it submits.
The merchant grants The Secret Mice of Sarasota permission
to display, resize, crop and format submitted materials for
use on the website and in program-related promotional
materials.
Offers, Coupons and Events
The merchant is responsible for the accuracy and legality
of all offers, coupons, discounts, events and promotions
submitted for publication.
The merchant is responsible for supplying all restrictions,
exclusions, redemption requirements, purchase requirements,
limitations and expiration dates applicable to an offer.
The merchant agrees to honor a published offer in accordance
with the terms supplied by the merchant through the stated
expiration date.
Expired Promotions
Expiration of an offer does not automatically remove the
merchant's business listing. An expired promotion may remain
displayed and may be identified as expired until the merchant
submits a replacement promotion or requests removal.
Content Approval
The Secret Mice of Sarasota reserves the right to decline,
edit, format or remove content that is inaccurate,
misleading, unlawful, inappropriate or inconsistent with
the family-friendly nature of the program.
Merchant Responsibility
Each merchant operates independently. The merchant is solely
responsible for its premises, products, services, food and
beverage service, employees, events, customer service,
promotions and fulfillment of merchant offers.
No Guarantee of Results
The Secret Mice of Sarasota does not guarantee any particular
amount of customer traffic, sales, revenue, publicity,
website traffic or other commercial result.
One-Time Setup Fee and Recurring Monthly Membership
Enrollment includes a one-time setup fee of $149.00 plus a
recurring Merchant Membership of $29.00 per month. The initial
amount due is $178.00, comprising the setup fee and first month's
membership. Membership automatically renews monthly until canceled.
By enrolling and completing checkout through Stripe, the
merchant authorizes an initial $178.00 charge (including the
$149.00 one-time setup fee and first $29.00 membership payment),
followed by recurring monthly charges of $29.00 to the payment
method provided through Stripe until membership is canceled.
Cancellation
The merchant may cancel its membership before the next
billing date to prevent the next recurring charge.
Cancellation applies to future billing periods. Charges
already processed are non-refundable except where required
by applicable law.
Merchant benefits and the merchant listing may remain active
through the end of the then-current paid billing period.
Thereafter, The Secret Mice of Sarasota may remove the
merchant's listing and promotional materials.
Program Changes
The Secret Mice of Sarasota may modify program features,
promotional opportunities, website presentation and
operational aspects of the program as the program develops.
Independent Businesses
Participation does not create a partnership, franchise,
employment relationship, joint venture or agency relationship
between the merchant and The Secret Mice of Sarasota.
Limitation of Responsibility
To the extent permitted by applicable law, The Secret Mice
of Sarasota is not responsible for claims, injuries, losses,
damages or disputes arising from a participating merchant's
premises, products, services, employees, food, events,
promotions or customer interactions.
Governing Law
This agreement is intended to be governed by the laws of
the State of Florida, subject to applicable law.
